Without Permission?

The article states that the album uses the image of the Silver Surfer without Marvel's permission. I find this unlikely. First, I doubt Marvel would simply ignore something like that. The album has been certified Platinum, it's not like a 15 year old in a basement stealing your trademarked material. Second, the cite doesn't specifically say Marvel wasn't paid/asked. It says the artist wasn't asked or compensated. If the art was made "for hire," his permission wouldn't be necessary. I'd like to see something more definitive. I just checked the liner notes of the 1999 remastered version of the album and it says the Silver Surfer likeness is used with permission and it mentions the Marvel Characters, Inc. copyright. Multiple sources state that the art was used with Marvel's permission. Also, if you look up primary sources such as are available on Discogs, the packaging clearly bears Marvel's trademark. The inference from Byrne's personal website is that he was ripped off, but artwork used was almost certainly "work made for hire", which was the norm back then, on a character he did not create nor own. So, he would not be the relevant entity to obtain permission from nor would he be entitled to additional compensation. (An artist credit would have been nice, though.) Consequently, I have modified the article so that it uses more neutral language regarding this issue. I have kept the link to Byrne's website intact and the article still notes that he did not receive any additional money for this use. --GentlemanGhost (séance) 09:46, 9 January 2019 (UTC)[reply]
